Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.

Due to the intimate nature of our products, we can only accept returns of unopened, unused items in their original packaging within 30 days of purchase. Defective or damaged items can be returned or exchanged regardless of use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

You agree to indemnify, defend, and hold harmless Rod, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, NY, and judgment on the award may be entered in any court having jurisdiction.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in New York, NY.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Rod regarding your use of our services and supersede all prior agreements and understandings.
